August 2, 2019
On 2 August 2019 the SDRCC Doping Tribunal decided to impose an 8 year period of ineligibility on the Bobsledder Derek Plug for his second anti-doping rule violation after his A and B samples tested positive for the prohibited substance Methyltestosterone.
In September 2019 the Athlete appealed the SDRCC decision of 2 August 2020 with the Court of Arbitration for Sport (CAS). However this appeal was denied by CAS on 6 January 2020 because it was filed too late.
Hereafter in January 2020 the Athlete filed an appeal with the SDRCC Doping Appeal Court after he was notificed by CCES about public disclosure of his case in the media.
However the Sole Arbitrator concludes that the SDRCC Doping Appeal Tribunal has no jurisdiction to hear the application filed by the Athlete because he is an international Athlete under the Rules. Instead he had to adress his appeal with CAS while his appeal was already denied in January 2020 because it was filed too late.
Therefore on 31 March 2020 the SDRCC Doping Appeal Tribunal decides to dismiss the Athlete's application.
