SDRCC 2020 Derek Plug vs CCES - Appeal
March 31, 2020
In February 2018 the Canadian Centre for Ethics in Sport (CCES) has reported an anti-doping rule violation against the bobsledder Derek Plug after his A and B samples tested positive for the prohibited substance Methyltestosterone as a second anti-doping rule violation.
After notification the Athlete gave a prompt admission, accepted the test results, the provisional suspension and he was heard for the SDRCC Doping Tribunal.
The Athlete asserted that the violation was not intentional, requested for a reduced sanction and believed that the supplements he used were the source of the positive test. However he repeatedly failed to file written submissions nor evidence in his defence in spite of numerous extensions granted by CCES and the Tribunal. His lawyer resigned in February 2019 and the Athlete was unable to retain a new lawyer in July 2019.
On 16 July 2019 the Arbitrator refused the Athlete's request for yet another adjournment and declared the proceedings closed because he failed again to present any evidence in his defence.
Consequently the Arbitrator deems the Athlete failed to provide any evidence that the violation was not intentional although given many opportunities to do so.
Therefore the SDRCC Doping Tribunal decides on 2 August 2019 to impose a 8 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 9 February 2018
